True cools down, lures TOT back to the negotiating table

True Corporation said it was ready to compromise over the 10-billion-baht compensation payment ruling although TOT Plc threatened to petition the Administrative Court to overrule it.
In a statement issued yesterday, True chief executive Supachai Chearavanont said that True had abided by the joint-operation agreement with TOT strictly, and thus TOT had no reason to raise it as an issue to revoke its concession.
He said that True\\\'s filing of the dispute over the share of revenues TOT gained from services on True\\\'s network to the arbitration process was in compliance with the terms and conditions accepted by both parties in the concession agreement.
He said the dispute occurred 10 years ago but no agreement was reached, forcing True to file petition to the arbitration process in 2002.
The concession agreement said any ruling by the arbitration judges would be accepted as final by both parties, he said.
Therefore, TOT had to respect the ruling. If the ruling favoured TOT\\\'s cause, True would also respect it, he said.
He said the amount TOT had to pay True comprised access-charge revenue accumulated over the past 10 years, and was only half of what True was seeking.
He said TOT\\\'s linking of the arbitration ruling with the decision to terminate True\\\'s concession was totally unfounded.
He believed that TOT\\\'s announcement to end the concession was more of an initiative from TOT to begin negotiations.
He said True had never considered TOT as a rival. Since TOT and True were among the few Thai companies left in this industry, he believed that both organisations should collaborate with each other to become more competitive in light of the Thai telecom industry\\\'s liberalisation and entrance of foreign competitors.
He said TOT might not want to carry the burden of future access-charge payments ordered by the arbitrators, while at the same time True wanted to convert its concession with TOT. Both parties should talk and find solutions, he said.
